Terms & Conditions
Last updated: 13 October 2026 · 36 detailed sections
1. Scope and acceptance
These Terms & Conditions govern enquiries, reservation requests, confirmed tours, transportation, excursions and any optional activities offered or arranged by ESCAPADA TOURS. Read them together with the Cancellation & Refund Policy and Privacy Policy. The applicable version is the one made available before your booking is confirmed. Mandatory UAE laws prevail over inconsistent wording.
2. Business identity and contact
ESCAPADA TOURS operates in Abu Dhabi, United Arab Emirates. The registered legal entity name, trade licence number, official business email and regulatory contact details must be completed and verified by management before this document is treated as final. Booking enquiries and complaints may be sent via WhatsApp at +971 50 317 9993.
3. Definitions
“Company”, “we” and “us” mean the licensed tour provider identified in the final booking confirmation. “Guest” and “customer” mean the person making or participating in a booking. “Booking request” means an unconfirmed enquiry. “Confirmed booking” means an accepted reservation with agreed services, price, date and payment arrangements. “Third-party operator” means a separate transport, water-sports or other service provider.
4. Website information and availability
Descriptions, pictures, sample itineraries, promotional material, availability and published prices are provided for general information and may change before a booking is confirmed. We will disclose material changes before acceptance. Errors in a displayed price or itinerary do not automatically create a confirmed contract; any remedy remains subject to applicable law.
5. Booking requests versus confirmations
Completing the website form, opening WhatsApp or receiving an automated response does not guarantee a seat. A booking becomes confirmed only after an authorized representative confirms the date, number of guests, agreed price, included services, meeting details and any payment requirements. Please verify your confirmation and report discrepancies promptly.
6. Customer information and accuracy
The person booking must provide accurate contact details, guest counts, ages where relevant, selected services and any practical accessibility or safety requirements necessary to arrange the trip. We may contact the booking holder to clarify details. Do not submit another person's sensitive medical information without a lawful basis and their appropriate authorization.
7. Booking for other people
A group organizer represents that they have authority to communicate the arrangements to their group, share these terms and supply necessary details. Each guest retains any rights they have under applicable law. Parents or guardians remain responsible for children under their care.
8. Age categories and children
For the currently advertised Khor Fakkan excursion, the child price applies to guests under 12 years of age, subject to the confirmed offer. Children must be accompanied and supervised by a responsible adult. Individual activities may have stricter age, height, weight or guardian-consent conditions established by their operators.
9. Prices and currency
Unless clearly stated otherwise, advertised prices are in UAE dirhams (AED). The current Khor Fakkan advertised rates are AED 119 per adult and AED 99 per child under 12. Prices may vary by date, season, group size, special offer or agreed private service; the confirmed quotation controls. Any applicable taxes or compulsory charges should be disclosed before payment.
10. What the standard tour includes
The confirmed itinerary determines what is included. The advertised Khor Fakkan day excursion generally describes air-conditioned transport, selected sightseeing and photo stops, beach time and specified refreshments. No particular attraction, beach condition or stop duration is guaranteed when safety, traffic, weather or authority instructions require reasonable changes.
11. Exclusions and optional purchases
Meals, personal shopping, unlisted admission charges and optional water sports or boat activities are not included unless the written confirmation explicitly says otherwise. Optional activities must be quoted and accepted separately. Third-party operators may require additional waivers or safety declarations that do not override non-excludable legal rights.
12. Payment methods and deadlines
The accepted booking confirmation should state the total price, amount due, due date, approved payment channel and any receipt details. Do not send payments to unverified personal accounts or unfamiliar links. Keep transaction records. A booking may be released if a disclosed payment deadline is missed, subject to applicable consumer rights.
13. Deposits and balances
If a deposit is required, the amount and due date of any remaining balance will be communicated before confirmation. Whether a deposit is refundable depends on the disclosed cancellation terms, the reason for cancellation and applicable law. No unannounced fees may be imposed.
14. Departure locations and arrival
Guests must arrive at the confirmed meeting point at least 30 minutes before departure to allow check-in and boarding. Meeting points, contact details and departure times are communicated in the booking confirmation. Guests are responsible for reaching the designated point safely and on time unless a different pickup arrangement is agreed in writing.
15. Late arrival and no-shows
Transport may depart at the scheduled time. If a guest misses departure or cannot be contacted, the booking will normally be treated as a no-show and amounts paid will generally be non-refundable under the published policy, except where mandatory law or a failure attributable to the Company requires otherwise. We cannot guarantee rejoining the tour.
16. Changes requested by customers
Date changes, passenger substitutions, activity changes and transfers must be requested as early as possible. Approval depends on available seats, supplier terms and operational feasibility. We will disclose any difference in price or charge before accepting the change. A request alone does not amend a confirmed booking.
17. Customer cancellations and refunds
Confirmed and paid customer bookings are generally non-refundable for voluntary cancellations, change of mind, no-shows and early departures, subject to the separate Cancellation & Refund Policy and non-waivable UAE consumer rights. No provision denies a lawful remedy where services are not delivered as agreed or a provider is at fault.
18. Cancellation or changes by the Company
We may need to cancel, postpone or reasonably modify a trip because of unsafe weather, road closures, official restrictions, insufficient operational capacity or circumstances beyond reasonable control. We will communicate material changes as soon as reasonably possible and provide any alternative, refund or other remedy required by law and the confirmed contract.
19. Weather, road and sea conditions
Beach access, visibility, mountain roads, marine conditions and optional water activities may be affected by changing conditions. The tour leader, driver, authorities and specialist operators may stop or change an activity for safety. A cancelled optional service will be handled according to the paid service, supplier arrangement and applicable law.
20. Itinerary changes and timing
Listed stops, photo opportunities and schedules are estimates unless expressly guaranteed. Traffic, weather, crowding, access restrictions and safety conditions may require changes. A minor reasonable adjustment is different from failure to deliver a material contracted service; customers retain their applicable legal remedies for material failures.
21. Transport and seat allocation
Guests must follow the driver's lawful instructions, remain seated and use seat belts where fitted and required. Smoking, unsafe behavior, obstruction of the driver and unauthorized transport of dangerous items are prohibited. Specific seating is not guaranteed unless confirmed. Transport standards and safety obligations remain governed by law.
22. Water activities and swimming
Swimming, kayaking, jet skiing, parasailing, boat rides and similar activities carry risks such as drowning, collision, equipment failure and changing currents. Guests must follow authorized operators' instructions, use provided protective equipment, respect designated areas and not participate while impaired. Participation may be refused for legitimate safety reasons.
23. Independent activity operators
Some optional services may be supplied by independent licensed operators. We will clarify who supplies and charges for a service where relevant. A third party's involvement does not automatically remove any responsibility the Company has under applicable law, contract or its own negligence.
24. Fitness, health and accessibility
Customers should assess whether the planned activities are suitable for them and tell us about accommodations needed to provide the service safely. We cannot provide medical advice. Operators may apply legitimate, proportionate safety restrictions. Contact us in advance for accessibility arrangements; availability must be confirmed rather than assumed.
25. Children's supervision and safety
Parents or guardians must remain responsible for supervising children throughout the trip, especially near roads, water, boats and elevated viewpoints. Children may not take part in restricted activities without the supervision and authorization required by the activity provider and applicable law.
26. Guest conduct
Guests must respect other passengers, staff, local communities, cultural norms, public decency rules and environmental regulations. Harassment, violence, intoxication creating a safety risk, illegal conduct and repeated refusal to follow safety directions may lead to removal where lawful and proportionate. Any consequences or refund entitlement will be assessed under applicable law.
27. Personal possessions
Keep passports, identification, money, electronics and valuables secure. Do not leave belongings unattended on beaches or in vehicles. Liability for loss, theft or damage depends on the circumstances, including any legally applicable duty of care; we do not exclude responsibility that cannot lawfully be excluded.
28. Accidents, emergencies and incident reporting
Immediately alert the tour leader or operator to an accident, injury, missing person or serious safety concern. In an emergency, contact the UAE emergency services as appropriate. Cooperate with reasonable incident reporting and preserve relevant information. We will respond to incidents in accordance with our legal and operational duties.
29. Liability and non-excludable rights
Participation in travel and recreational activities involves inherent risks, but no clause in these terms excludes or limits liability for negligence, unlawful conduct, breach of mandatory safety obligations, fraud or any liability that applicable law does not allow to be excluded. Any allocation of responsibility will be determined by the contract, facts and UAE law.
30. Force majeure and extraordinary events
Events beyond reasonable control, such as extreme weather, official closures or serious disruptions, may affect performance. We will act reasonably to reduce disruption and communicate options. Any right to a refund, postponement or other remedy depends on applicable law, the contract and services actually delivered; “force majeure” does not automatically eliminate all consumer rights.
31. Photos, video and promotional use
Guests may appear incidentally in group or location imagery. We will seek any legally required permission before using identifiable guest images for marketing, with particular care for children. Tell the coordinator if you do not want to be featured. Personal data processing is described in the Privacy Policy.
32. Privacy and booking records
We use customer data to respond to enquiries, manage reservations and deliver services. Booking information may be processed by our hosting, communications and database providers, including international processing as described in the Privacy Policy. Separate consent may be required for marketing or optional tracking.
33. Special offers and group rates
Promotions apply only during their stated period and subject to their disclosed eligibility, capacity and other conditions. Group prices must be agreed in writing; illustrative group rates are not binding. Discounts cannot be combined unless confirmed. Material restrictions must be disclosed before booking.
34. Complaints and dispute resolution
Send complaints promptly via the published contact details, including your booking reference, date and supporting information. We will review and respond within a reasonable period. You retain the right to contact competent UAE consumer-protection authorities or pursue legal remedies where applicable.
35. Governing law and interpretation
These terms are interpreted under applicable UAE law. Any dispute-resolution clause is subject to mandatory jurisdiction and consumer-protection rules. If one clause is unenforceable, the remaining clauses continue to the extent legally possible. Headings are for convenience only.
36. Updates and effective date
We may update these terms for future bookings. Material changes will be dated and posted. An updated policy does not automatically change the terms of an existing confirmed booking without a lawful basis or agreement. Last updated: 13 October 2026.
